1. Acceptance of Terms

By accessing or using OxalateGuard ("the Service"), available at oxalateguard.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all visitors, users, and anyone who accesses or uses the Service, whether on a free or premium plan.

2. Description of Service

OxalateGuard is a dietary oxalate tracking application designed to help people — particularly kidney stone formers — understand and manage their oxalate intake. The Service includes:

  • A searchable food database with oxalate content data sourced from Harvard, USDA, and peer-reviewed scientific papers
  • Daily food logging with personalized oxalate budgets
  • Recipe URL analysis for estimated oxalate content
  • Barcode scanning for packaged products
  • Community contributions ("Scout Mode") for expanding product data
  • Educational guides on cooking methods and oxalate reduction

3. Not Medical Advice

OxalateGuard is for informational and educational purposes only. The Service does not provide medical advice, diagnoses, or treatment recommendations.

Oxalate content data is compiled from published scientific sources and may contain inaccuracies. Actual oxalate levels in food vary depending on growing conditions, preparation methods, and other factors.

Always consult your physician, urologist, or registered dietitian before making dietary changes based on information from this Service. Do not disregard professional medical advice or delay seeking it because of something you read or calculated using OxalateGuard.

4. Accounts

To access certain features, you must create an account through our authentication provider (Clerk). You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the security of your account credentials
  • All activity that occurs under your account

You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent to use the Service.

You must not create accounts through automated means or use another person's account without permission.

5. Subscriptions and Payments

OxalateGuard offers a free tier with limited functionality and a premium subscription ("OxalateGuard Premium") with expanded features.

Pricing

Premium is available at $4.99 per month or $39.99 per year. Prices are in USD and may change with reasonable notice.

Billing

Payments are processed securely by Stripe. Subscriptions renew automatically at the end of each billing cycle unless cancelled.

Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation, you retain premium access until the end of your current billing period. No refunds are provided for partial billing periods.

Free Tier Limits

The free tier includes usage limits on features such as barcode scanning. These limits may be adjusted at our discretion. Exceeding free tier limits requires a premium subscription.

6. User Content

"User Content" includes any data, text, or images you submit to the Service, including food logs, profile information, recipe URLs, and community contributions.

  • Ownership: You retain ownership of your User Content.
  • License: By submitting User Content, you grant OxalateGuard a non-exclusive, worldwide license to use, store, and process that content as necessary to provide and improve the Service.
  • Responsibility: You are solely responsible for the accuracy and legality of your User Content. Do not submit content that infringes others' rights or violates any law.

7. Community Contributions (Scout Mode)

Scout Mode allows you to contribute product data, including photographs of products, barcodes, and ingredient lists. By participating in Scout Mode, you agree to the following:

  • Open Data Sharing: Approved contributions (including product photos and ingredient data) may be submitted to Open Food Facts, a public food database licensed under CC BY-SA 3.0. Once published to Open Food Facts, this data becomes publicly available and cannot be retracted.
  • Quality Standards: Contributions are subject to review. Repeatedly submitting low-quality, inaccurate, or inappropriate content may result in restricted contribution privileges.
  • Rewards: Scout contributions may earn points and badges. These are for recognition only and have no monetary value. We reserve the right to revoke rewards for contributions that are later found to be inaccurate or inappropriate.
  • Photos: You must only submit photos you have taken yourself. Do not submit photos containing personal information, copyrighted material, or anything unrelated to the product.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to any part of the Service, its servers, or any connected systems
  • Scrape, crawl, or use automated means to extract data from the Service beyond what is provided through our public API
  • Interfere with or disrupt the Service or the servers and networks that host it
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Upload viruses, malware, or any other malicious code

9. Intellectual Property

The Service, including its design, code, branding, food database curation, and original content, is owned by OxalateGuard and protected by applicable intellectual property laws.

Underlying oxalate data is sourced from publicly available scientific literature (Harvard, USDA, peer-reviewed papers) and is not claimed as proprietary. However, our compilation, categorization, risk classifications, and presentation of that data are proprietary to OxalateGuard.

You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Oxalate data will be accurate, complete, or current — food composition varies and scientific understanding evolves
  • The Service will meet your specific health needs or prevent kidney stones
  • Results from recipe analysis or barcode scanning will be precise

11. Limitation of Liability

To the maximum extent permitted by applicable law, OxalateGuard and its founder, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, health outcomes, or goodwill, arising from or related to your use of the Service.

In no event shall our total liability exceed the amount you have paid us in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination include but are not limited to:

  • Violation of these Terms
  • Abusive or fraudulent activity
  • Extended inactivity (accounts inactive for more than 24 months may be deleted)

You may delete your account at any time from your profile settings. Upon deletion, your server-side data will be permanently removed in accordance with our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via email or an in-app notice.

Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of competent jurisdiction.
